The Gqeberha High Court in the Eastern Cape is expected to hand down judgment on the National Prosecuting Authority’s(NPA) leave to appeal the acquittal of Televangelist Timothy Omotoso.
Omotoso and his co-accused Lusanda Sulani and Zukiswa Sitho were facing a string of charges, including rape and human trafficking.
Judge Irma Schoeman found them not guilty, citing failure by the NPA to prove its case beyond a reasonable doubt.
In July, Schoeman refused the NPA’s application to give reasons for acquitting Omotoso. But the state contends Judge Schoeman erred in law when she found Omotoso and his co-accused not guilty.
