eThekwini Mayor accepts court ruling in R30m dispute

eThekwini Mayor Cyril Xaba says he respects the Constitutional Court’s judgment, which ruled in favour of a service provider, resulting in the city losing over R30 million.

The case stems from a 2013 dispute between the municipality and the service provider whose contract was terminated and the company blacklisted — actions that were carried out without following due process.

The service provider subsequently took legal action against the city, challenging the decision.

Mayoral Spokesperson Mluleki Mntungwa explained that since Mayor Xaba took office, he has had to deal with several serious allegations and legal matters linked to decisions made before his tenure.

“Since Mayor Xaba assumed office, many serious allegations have been made on issues that occurred before his time. He has always believed that when officials have exhausted their internal processes and the other party is still not satisfied, the best way to resolve matters is through the court as an independent arbiter,” Mntungwa said.

Mntungwa added that the mayor remains committed to transparency and good governance.

“The mayor wants to assure eThekwini residents that we are working diligently not only to improve service delivery, but also governance issues,” says Mntungwa.

Mayor Xaba has accepted the Constitutional Court’s decision and is now awaiting the finalisation of the quantum.
