The Economic Freedom Fighters (EFF) has welcomed the Constitutional Court judgment which has dismissed lobby group AfriForum’s application for leave to appeal the ruling, which found that the “Kill the Boer” chant did not constitute hate speech.
The EFF has described AfriForum’s appeal at the ConCourt against the findings of the Equality Court and Supreme Court of Appeals as a frivolous and cynical attempt to weaponise the legal system and silence black resistance.

Party leader Julius Malema continued to chant the song, most recently at the party’s Human Rights Day event in Sharpeville on the Vaal, Gauteng.
EFF National Spokesperson Thembi Msane says, “The EFF has always been clear, we will not be intimidated, silenced, or censored by racists who refuse to acknowledge the sins of their past. The liberation struggle belongs to us, and no court, no lobby group, and no reactionary force will ever erase our history or dictate how we remember our struggle. The Constitutional Court ruling is a victory for truth, for historical justice, and for the freedom to commemorate our fight against oppression.”
