EFF to challenge fuel levy increase in court

The Economic Freedom Fighters is set to challenge the proposed fuel levy increase in court.

Earlier today, the party filed an urgent application in the Western Cape High Court to interdict the Minister of Finance Enoch Godongwana from increasing the fuel levy by 16 cents per litre on petrol, and 15 cents per litre on diesel, as announced in his Budget Speech last week.

EFF Treasurer General Omphile Maotwe says the proposal is illegal, unconstitutional and procedurally flawed.

Maotwe says the EFF’s argument is that the minister does not hold the authority to introduce a national tax with a regulation.

“Section 77 of the constitution is very clear that when there’s a national tax that is going to apply to everybody, particularly when it applies to a general application, which is the case with the fuel levy, it has to follow a legislative process in the money bills act. Which is clear that after the minister has tabled, Parliament must then establish a committee and then an amendment should come through in the form of legislation,” says Maotwe.
