Court to rule on Phala Phala trial within trial decision


The Modimolle Regional Court in Limpopo is expected to make a ruling on Thursday on whether to declare a trial within a trial on the statements made by one of the witnesses.

The state’s fourth witness in the case of theft of more than half a million US dollars at President Cyril Ramaphosa’s Phala Phala farm in Bela Bela has given two contradicting statements.

In one statement, the witness indicates that he was given $30 US dollars and in the second one, he was paid R7 000 by accused number one, Immanuela David, to transport him and other suspects to Benoni in Gauteng.

The witness is testifying against three accused, Immanuela David and the siblings Floriana and Ndilinasho Joseph, who broke into the Ramaphosa’s farm and stole 580 000 US dollars in October 2020.

The court will make a ruling virtually.

State prosecutor Khetheni Munyai made an application for a trial within a trial due to contradicting statements.
