Court strikes off bids to halt Vhembe ANC regional conference

Two separate urgent applications to interdict the Vhembe African National Congree (ANC) regional elective conference in Limpopo were struck off the roll by the Thohoyandou High Court. 

Some ANC members from various branches, along with members of the party’s Regional Task Team (RTT), filed separate court applications seeking to stop the conference scheduled to be held in Thohoyandou. 

In their affidavits, the applicants argued that the conference should not proceed until concerns over the credentials of participating branches were resolved. 

Judge Thogomelani Tshidada presided over both matters and struck the first urgent application from the roll, stating that key respondents, the ANC National Dispute Resolution Committee and ANC Secretary General Fikile Mbalula, had not been served with answering affidavits. 

“This court is not satisfied that the applicants complied with the requirements of service to all the cited respondents. This application is struck off from the roll,” says Judge Tshidada in his ruling on the matter involving ANC branch members. 

In the second matter brought by members of the RTT, Judge Tshidada also ruled that the application was not properly before the court. He found that Tshitereke Matibe, who was cited as the sixth respondent and is central to the dispute, had not been served with a notice to respond. 

“Mr Matibe, as the one who raised those issues and being cited as the 6th respondent, in order for him to come and respond to this application, he could only have done so soon after he would have been served. It would be an irregularity for this court to hear a matter in the absence of an affected party. This application is struck from the roll for lack of service,” he ruled. 

ANC Limpopo Provincial Secretary Rueben Madadzhe confirmed that the regional conference will go ahead as planned.
