The Mpumalanga Division of the High Court in Mbombela has ordered insurance company Alexander Forbes, not to pay out the R44.7 million of former Deputy President David Mabuza to his widow, Patience Mnisi.
This is an interim order until the Mabuza family resolves their disputes and to determine whether these funds are his pension.
Mabuza nominated Mnisi as a beneficiary however his daughter, Tamara Silinda, claims that she and her siblings are entitled to benefit from their father’s estate.
The court has also ordered the insurance company to carry the court’s legal costs and those of the applicants’ legal representatives.
Judge Henck Roelofse made the order earlier Tuesday.
“So, there was no other way the for the applicant to protect their prima facie rights but to come to this court. I’m therefore satisfied that I am with the information in front of me. And with the arguments that I’ve heard, I can grant an interim order to remain the status quo pending the finalisation of the main dispute which is the matter of this fund.”
