Court dismisses Cholota’s appeal bid to avoid prosecution


The Free State High Court has dismissed Moroadi Cholota’s application for leave to appeal the dismissal of her bid not to be prosecuted in the R255-million asbestos roof removal case.

Cholota had argued that the Supreme Court of Appeal could arrive at a different conclusion.

In a trial-within-a-trial, the high court had found that the state proved beyond a reasonable doubt that it did not misrepresent facts when applying to United States authorities for her extradition.

Cholota, who is the former personal assistant of former Free State premier Ace Magashule, contended that the court misapplied legal principles of the law of evidence in its judgment.

However, the court has ruled that there are no questions of law to be reserved for the Supreme Court of Appeal.
