Court dismisses Black Rock’s bid to freeze portion of Makate’s payout


An attempt by Black Rock Mining to temporarily freeze a portion of the ‘Please Call Me’ settlement paid by Vodacom to Nkosana Makate has been dismissed in the High Court in Johannesburg.

The court ruled that Black Rock, represented by businessman Errol Elsdon, failed to prove that Makate intended to hide or dissipate the funds.

Black Rock had approached the court on an urgent basis to block access to 40 percent of Makate’s settlement which remains subject to a non-disclosure agreement.

The UK investor claimed to be entitled to the money under a disputed funding agreement dating back to 2011.

Attorney for Black Rock Mining Sinenhlanhla Mnguni says, “It looks like we’ll have to make a decision on whether we proceed with the arbitration or find other ways of enforcing our clients’ rights. It’s still fresh and we’re not pressed, as far as time is concerned, to make a move which will, of course, safeguard the rights and interests of our client. But we’re confident that in the next few days, we will have a way forward in as far as this matter is concerned.”
