ConCourt orders Cholota case be returned to Free State High Court


Deputy Chief Justice, Dunstan Mlambo, has ruled that Moroadi Cholota’s case be remitted to the High Court in the Free State.

Justice Mlambo says while Cholota’s extradition was unlawful, it does not deprive the high court of criminal jurisdiction to prosecute.

Cholota, the former PA of Ace Magashule, was extradited from US in 2024 to face corruption and money laundering charges linked to the Free State asbestos case.

Justice Mlambo delivered the ruling.

“However, the fact that the extradition was unlawful as aforesaid does not of itself deprive the High Court of South Africa Free State Division, Bloemfontein of criminal jurisdiction over the respondent. The matter is remitted to the High Court of South Africa Free State Division, Bloemfontein to determine the remaining grounds of the respondent’s special plea.”
