The legal representative for Chief Simphiwe Zuma, accused of killing the Democratic Alliance (DA) Chief Whip in the Umgeni municipality, Nhlalayenza Zuma, is accusing the State of illegally obtaining evidence.
The Howick Magistrate’s Court is hearing closing arguments in Zuma’s bail application. According to Zuma’s lawyer, Sithembiso Mdladla, the State did not follow the legal procedures to obtain its evidence.
The court has heard that the State had no authority to download information from Zuma’s phone, which was confiscated during a raid at Durban’s Westville prison, where he is being detained.
Mdladla further said the State’s evidence is fabricated and misleading. The defence said a case has been opened against the investigating officer, Delani Chamane, for allegedly assaulting Zuma.
