KwaZulu-Natal Police Commissioner Lieutenant General Nhlanhla Mkhwanazi arrives to give testimony at the Madlanga Commission of Inquiry.
Advocate Nyoko Muvangua, who is arguing for President Cyril Ramaphosa, has defended the establishment of the Madlanga Commission.
Muvangua says the contention by uMkhonto weSizwe Party (MKP) and former President Jacob Zuma stating that the Madlanga Commission is biased, is fundamentally problematic.
The Pretoria High Court sitting in the Palace of Justice is hearing arguments where the MKP and Zuma are challenging President Ramaphosa’s decision to establish the Madlanga Commission.
“The applicant’s argument on institutional bias is that the judiciary cannot be both an accused institution and also the investigating institution via one of its own members. This, as we understand it, as I said before, taints the commission. But in applying the Van Rooyen test, which is similar to that given by SARFU, it is clear that the reasonable observer would know that the allegations by General Mkwanazi are of the existence of, to use loose language, rotten apples within the judiciary.”
