Newly Appointed National Director of Public Prosecutions, Advocate Andy Mothibi
The Council for the Advancement of the South African Constitution (CASAC) says the appointment of Andy Mothibi as the next National Director of Public Prosecutions is unexpected.
President Cyril Ramaphosa announced the appointment on Tuesday.
It will take effect on February 1, 2026, as the tenure of the current head, Shamila Batohi, comes to an end.

Last month, the Advisory Panel interviewed six candidates for the position; however, in the report it submitted to Ramaphosa it indicated that none was suitable.
CASAC executive secretary Lawson Naidoo says that it would be much better if the President asked the panel to interview Mothibi first before the appointment.
“I think it’s a bit of a surprise that the President has made this announcement in a manner that he did, but I think the appointment of Mothibi must be welcomed. He’s certainly a seasoned operator within the criminal justice system and brings with him a track record that will help the NPA to re-establish its credibility in the public.”
“The concern around the process, however, is a legitimate one. It would have been better if the President said to the panel I see your report, you’ve not recommended anyone, but can you please consider the following person/persons and conduct additional interviews before that appointment.” –Reporting by Ntombi Sithubi
