Sibanyoni withdraws application to stop arrest in extortion case


The National Prosecuting Authority (NPA) has confirmed the withdrawal of an urgent court application brought by Madoda Johannes Sibanyoni and his co-accused to stop their arrest in an extortion case.

According to the NPA, attorneys representing Sibanyoni and co-accused Sindane filed a notice of withdrawal on Friday.

The application, filed earlier this week, sought to interdict the execution of a J50 warrant of arrest issued after prosecutors re-enrolled a criminal case that had been struck off the roll by the Kwaggafontein Magistrate’s Court on 18 May.

The matter had been set down for hearing in the Mbombela High Court on 2 June.

“Their filing of the notice of withdrawal brings the matter to an end as far as the re-enrolment of the criminal case and the warrants of arrest are concerned,” the NPA said.

The authority also noted that the Magistrates Commission has confirmed it is investigating a complaint lodged by the Director of Public Prosecutions in Mpumalanga against Chief Magistrate Tonjeni.

National Director of Public Prosecutions Advocate Andy Mothibi reiterated the NPA’s commitment to pursuing all lawful avenues to uphold the rule of law and ensure that those accused of criminal conduct are held accountable.
