The National Prosecuting Authority (NPA) has filed a formal complaint with the Magistrates Commission against Chief Magistrate Tuletu Tonjeni following proceedings in the Kwaggafontein court in Mpumalanga last week.
The complaint relates to concerns over the rulings she made during the State versus Madoda Johannes Sibanyoni and other matters.
The rulings include convicting a prosecutor for contempt, authorising a warrant of arrest against him and removing the case from the court roll.
Last week, the NPA filed a notice for leave to appeal the ruling.
“We believe that when the Chief Magistrate presided, there were certain things that were not done properly. One, for example, is the use of the language on the 15th against the prosecutor. But also, we are looking at the fact that she was able to convene a court when the person who is supposed to convene the court is supposed to be the prosecutor. She convened the court, and we believe that is wrong and we want the Magistrates Commission to then do an inquiry and look at the conduct of the magistrate,” says NPA spokesperson Kaizer Kganyago.
