Judge loses patience with delays in Modack trial


Monday is D-day for the defence in the trial of alleged Cape Town underworld crime boss, Nafiz Modack, in the Western Cape High Court.

Presiding Judge Robert Henney has ordered that the defence and the state make submissions on why the defence’s case should not be closed.
This comes after yet another postponement due to the unavailability of a witness that the defence had called.

Modack, along with 14 co-accused, face more than 100 charges, including money laundering, racketeering, extortion and the murder of anti-Gang Unit detective, Charl Kinnear.

Judge Robert Henney said he was running out of patience over the frequent postponement requests.

“I also want the full setup regarding all the delays and everything related to that, so that I can make a proper and informed decision about whether I should go that route. It’s drastic, but it will be done because every day you stand here in front of me, you don’t know where the witness is, what the witness is doing, or where to find the witness,” says Judge Henney.
