Alleged mastermind behind Ngobozana massacre Mzukisi Ndamase (46).
Accused number four in the trial within a trial of six men accused of brutally killing 18 people at Ngobozana village in Lusikisiki, Eastern Cape, has admitted during cross-examination that he was not assaulted during questioning.
Thirty-three-year-old Bonga Hintsa was under cross-examination by State Counsel Advocate Mfundo Makhubalo at the Mthatha High Court special sitting in Lusikisiki.
Hintsa and two other co-accused, earlier this year, objected to the submission of their confessions as evidence before court, claiming they were tortured into admitting involvement in the massacre.
During cross-examination, Hintsa agreed that he was not assaulted to confess or make a statement, but the assault and threats resulted into him making a confession.
Adv Mfundo Makhubalo put it to Hintsa that he was never put inside a dog enclosure of the vehicle they were traveling in on the way to Port Shepstone Police Station in KwaZulu Natal after their arrest.
Makhubalo further asked Hintsa why he did not make a request to the court to have the footage of the day in question as there’s evidence before court that there are cameras at the station.
Hintsa said he did ask his legal representative, Zama Somahela, but he said he was not sure if he could assist him with that as it had been long after the incident and was not sure if the footage would be available.
The matter has been adjourned until Thursday.
