High Court dismisses MKP’s bid to halt Batohi’s pension payout


The Gauteng High Court has dismissed with costs) the uMkhonto weSizwe party’s (MKP) bid to block the payment of former National Director of Public Prosecutions (NDPP) Adv. Shamila Batohi’s pension and other post-term gratuities.\

The MKP in their bid argued that the payment of public funds should be “lawful, rational and constitutionally defensible” in circumstances where concerns are raised about what the party describes as Batohi’s “misconduct” which was met with strong opposition from the respondents who argued that the matter was without merit and should fail.

Following arguments, the High Court in an electronic court order uploaded on caselines dismissed the part A application for an interim interdict and ordered the MKP to pay costs on Scale C.
