Former North West deputy director of Public Prosecutions, Advocate Sello Maema, will continue to testify before the Nkabinde Enquiry in Pretoria on wednesday.
On Tuesday, he said former National Director of Public Prosecutions advocate Shamila Batohi took the decision to have charges against the members of the CATO Manor Police Unit withdrawn. This was despite what Maema claimed was overwhelming evidence against the unit.
KwaZulu-Natal Hawks boss Johan Booysen had led the unit which had been accused of the murders of members of the Kwa-Maphumulo Taxi Association in 2008.
Maema urged that Advocate Batohi’s successor, Advocate Andy Mothibi, must revisit the issue.
“I would say the most appropriate just to remove any doubt, though I am not in his shoes I would approach the court to acquire a declaratory order just to remove any ambiguity.”
