Lawyers on behalf of Judges’ Secretary, Andiswa Mengo, the complainant in the landmark sexual harassment probe against Eastern Cape Judge President Selby Mbenenge say that the misconduct finding against the top Judge affirms that his conduct was “improper”.
This after the Judicial Conduct Tribunal recommended a lighter sanction against the top Judge, who they found initiated and conducted a “flirtatious relationship” with Mengo in the workplace, reaching the conclusion that it amounts to a degree of misconduct.

The Tribunal, in its report, cited among other things a loss of credibility findings against Mengo. The recommendation will now head to the Judicial Service Commission (JSC), who will consider the report and make a final finding against the top Judge. Mengo’s legal team (The Women’s Legal Centre) state that their client retains the right to consider further legal recourse, including the possibility of taking the Tribunal’s findings on review.
